1. Agreement
By using upupeducation.com or booking services with Up and Up Education (高升教育), you agree to these Terms of Service. If you do not agree, please do not use our website or services.
2. Services
We provide one-on-one and small-group tutoring in NY State Tests, SHSAT, Hunter College HS Test, SAT, ACT, college admissions coaching, and related academic preparation. All instruction takes place at our Brooklyn location, a partner location, or online by prior arrangement.
Outcomes, including test-score improvements or admissions results, are based on real historical student data. Past performance does not guarantee future results. We do not promise admission to any specific school or a specific score improvement.
3. Scheduling and cancellation
Consultations and lessons are scheduled through our booking system. You may reschedule or cancel your session up to 24 hours before the scheduled start time without penalty. Cancellations made with less than 24 hours' notice may be billed at the full session rate, at our discretion.
4. Payment
Tutoring packages and hourly rates are quoted in writing before services begin. Payment terms (deposits, instalments, and final payment) will be specified in your enrollment agreement. Late payments may result in suspension of services.
5. Student and parent responsibilities
For the student to get the most out of tutoring, we ask that:
- The student attend scheduled sessions on time and ready to work.
- Homework and practice materials be completed between sessions as assigned.
- Parents communicate any concerns, diagnoses, or learning accommodations so we can teach accordingly.
6. Our responsibilities
We will:
- Provide qualified instructors who have earned admission to, graduated from, or are currently enrolled at competitive colleges and universities.
- Maintain a safe, respectful learning environment.
- Communicate progress updates and flag concerns to parents.
- Protect your family's information per our Privacy Policy and COPPA Notice.
7. Intellectual property
All original course materials, practice problems, answer keys, and instructional content produced by Up and Up Education are our intellectual property. You may use them for your own learning but may not copy, distribute, resell, or publish them without written permission.
Students retain ownership of their own essays and written work.
8. Website use
You agree not to:
- Attempt to gain unauthorized access to any part of the site.
- Scrape or copy the site's content for commercial use.
- Submit false information through our contact or booking forms.
- Use the site for any unlawful purpose.
9. Disclaimers
The website and services are provided "as is." We make no warranties about uninterrupted access, error-free operation, or the accuracy of third-party information (such as exam dates or school policies) referenced on the site. Always verify important information directly with the administering body.
10. Limitation of liability
To the extent permitted by New York law, Up and Up Education's total liability for any claim arising out of your use of our website or services will not exceed the amount you paid us for tutoring in the six months preceding the claim.
11. Governing law and disputes
These Terms are governed by the laws of the State of New York. Any dispute will first be addressed through good-faith discussion. If unresolved, it will be brought in state or federal court in Kings County, New York.
12. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top will reflect any changes. Material changes will be communicated to active clients by email.
